Legal Question in Family Law in New York

bigamy

The husband is incarcerated, married (3) times. He was under the impression that his first wife divorced him in 1989. He married for a second time several years later, divorced the second wife, and remarried a third time. Would the third marriage be legal? Is that marriage null and void? Can they remarry?

Assuming that there was never a divorce in 1989, no future marriages would be deemed legal. He would have to obtain a divorce for the first marriage and then re-marry.
