Legal Question in Family Law in New York

What can i do if my ex boyfriend is trying to obtain custody of our 3 month old daughter? he lives with his brother who was recently bailed out of jail for attempted burglary,does not have the funds to care for our daughter, uses an illegal substance (marijuana) on a daily basis. was arrested for domestic violence once before and in my opinion he is mentally unstable to care for our child without my supervision or the supervision of the authorities. he has been verbally and mentally abusive to me for over a year, the cops were called to our apartment recently (prior to his moving out of our apartment) because of him physically manhandling me. what should i do to assure that his family or him do not obtain any type of custody except for supervised visitations over my daughter. i really do fear him hurting her because of his hatred towards me.

The question that has to be answered is where you stand with the Family Court. Has he filed a petition? Have you?

In any event it would be prudent to consult with a family law attorney to prepare a custody petition and present your case to the court.
