Legal Question in Family Law in New York

Name Change

My husband and I are going to get a divorce. It is necessary and we are not going to have any financial or child issues. My daughter is his biological daughter but has my last name because we were not married when we had her and I don't know how to go about getting her last name changed and his name added to the birth certificate and how much that would cost.

Re: Name Change

Assuming it is not challenged by him, go to family court and file for a finding of paternity. If he admits and acknowledges paternity, then it is not a problem. The cost should be under One Hundred Dollars.

Good luck.
