Legal Question in Family Law in New York

Child Custody

I have joint custodial custody w/ex wife of our daughter. Looking at moving down south to North Carolina. Can I split time between schools w/daughter? IN other words, half school year up in New York. The other half school year to finish down in North Carolina. Have been told this is possible, from other divorced parents. Trying to split time between myself and ex-wife. Without separating too much between families. Do I have the legal right to do this? I will have a better financial status after moving.

I provide all benefits for my daughter. Not looking for any support from ex-wife.

Re: Child Custody

It is highly unlikely that a judge would order the type of arrangement that you are proposing. However, if your ex wife agreed to it, you could do it. If she does not agree, since you are the one moving, you would probably end up with a schedule that included the summer, most vacation time, and other blocks of time in North Carolina.
