Legal Question in Family Law in New York

child custody

my stepson came to live w/us 4 years ago - his mother lost custody through child protective (when we saw he was in an unstable home). his mother has since moved to a different state, gotten a job and left the (abusive) boyfriend. she wants us to hand over custody (which we wont) but even if she goes to court, would the judge allow her to take the child from NY to Florida? Isn't there a 50 mile rule?
