Legal Question in Family Law in New York

child custody and support

My 18 and 16 year old children have decided to move in with their father because they don't like my rules. There are very few rules there. My questions are: Can they make this decision themselves? I understand that I would then be responsible for child support. My other question is: If I get remarried, is child support based on my income, or our combined income? Thank you

Re: child custody and support

This is a sad, but increasingly common phenonenon in our post-divorce society. It is the virtual bribery of teenage children, too young to exercise sound judgment as to what is in their best interests, but old enough to make everyone miserable until they get what they think they want.

Because these cases are very fact-specific, I would need to meet with you before I can advise you, including the imputed income issue. I practice in NYC and Long Island. If you wish to dicuss this with me privately, please call to scheudle a confidential consultation. (516) 741-7799. There is a consultation fee of $250.
