Legal Question in Family Law in New York

Child Support

My gross salery is around 25,000 a year My gross per month is 2000. I know the 17% suport in taking off that amount.

I would be nice but I only net 1380 after all deductions. If I am court ordered too pay 17% of gross, I will no longer be able too have money too pay bills.

Does child suport payments make it impossible for you too afford too live?

17% of 2000=340

1380-340=1040(new net)

1040 is impossible too live on everyone needs a place too live and transportation to see their child. If im forced to pay that I will lose my apartment my car and go bankrupt.

Everyone I know pays rent/morage, car payment, phone, power/heat, insurance and food. No matter which way i add up the amount I am in the RED.

Does the court consider wether and paying party can live on what would be left?

Re: Child Support

child support can be tough. the court orders child support based on the law and the child's needs, not the paying parent's needs. HOWEVER, something can be done about your tax situation. perhaps you can squeeze some more take-home pay from your current taxes. Also, some work can be done to ease your current bills. While Bankruptcy is one option, there are also others. you are welcome to a consultation for no charge at my office at 42 west 44th st, ny,ny please call for an appointment first. 646-591-5786
