Legal Question in Family Law in New York

Interstate Child Support

My former wife and my children have lived in Florida for the past 8 years.

Nassau County continues to apply NY jurisdiction over this case as my former wife strives to keep the case out of Florida jurisdiction because child support ends at age 19 instead of age 21 as mandated in NY.

Is there something that can be done to get this out of NY? The children are 18 and 20 years of age.

Thank you.

Re: Interstate Child Support

while it is possible/easy to have jurisdiction for the case in Florida if the ex-wife and children are residents of the state of Florida,

there is still the legal question of 'choice of law'. This issue concerns whether the Florida court will apply Florida or NY law to the case. Every 1st year law student will give you the same answer: the court will apply NY law. you are welcome to a consultation for no charge at my office at 42 west 44th st, ny,ny please call for an appointment first. 646-591-5786
