Legal Question in Family Law in New York

His child, but not his child

My x-husband and I have been legaly divorced for about 9years now. When I first met him, my duaghter was 7 months old.(she is now 17). I wanted to be left alone but he came

after me through the courts for visitation rights. He fathered her until 2 years ago. now that he's remarrying he no longer wants to pay child support. I have a new court date for Sept.14, 2005. he says he will tell the judge that she isn't his. Will I get in trouble for letting him raise her for so long? Or will the judge side with me? Help me please. I'm scared

Re: His child, but not his child

There is nothing bad that can happen to you under these facts.

Is the child his, or just born while you were married to him? There is nothing bad that can happen to you in either case.

However, he can only avoid support if a blood test shows he is not the father.
