Legal Question in Family Law in New York

My child's father is currently involved in a child support action. It's all a bit muddled but here are the facts..

my child is six years old, the father now has two (twin) 10 month olds that he has been charged to support. I have been served a subpoena duces tecum and a subpoena ad testificandum by the woman's lawyer asking for all of my information and bank records.

other info: The other mother had taken to harassing me and was arrested twice and was recently arraigned.

I do not wish her to have my information or be involved in her case at all. The father pays child support to me and also i will be filing a new case to add my new child with him. he and i have not been together for some time now.

First: Since you are receiving child support and you received a valid subpoena you will be required to either get an attorney and fight the subpoena in court or answer the subpoena. You can try to decline to answer some questions that you feel are not proper but that will become a decision for the court in the end.

Second: The fact that you have another child, you need to file a petition for support as soon as possible since that will have a bearing on what you will eventually get in support for your child.

Third: You might be able to use the harassment charges, if you are the complainant, to try to block her from getting your personal information.
