Legal Question in Family Law in New York

contested or uncontested divorce?

Before filing for divorce, my attorney asked me to pay a retainer which will be enough if the divorce is uncontested. A conference in court was scheduled to get my husband and I opinion on the property and the ground. We both agreed on both issues. Before this conference was set up, I asked my attorney if that conference is considered like going to court to fight and she said no. So I assumed that since we both agreed on the property and ground this was an uncontested divorce. Now she says I owe her more money. What do you think? Is this a contested or uncontested divorce? There was no trial, only 1 conference to get our opinion.

I disagree with paying that money, she should have told me when this divorce became contested to her.

What do you think?Would you consider this a contested or uncontested divorce?

Re: contested or uncontested divorce?

You should have a written contract with your lawyer, known as a retainer agreement. That written agreement governs the fees the lawyer will charge.
