Legal Question in Family Law in New York

If in a divorce decree a stipulation is "Equitable Distribution is not an issue", does this preclude the defendant from future attachment of plaintiff's pension which ordinarily she would be entitled? In other words, has she "waived" her rights to such pension attachment?
