Legal Question in Family Law in New York

emancipation court order

Son (2l) was emancipated in family court (court Order). During last several years support money has been taken out by my employer and sent to the county support collection unit (CSCU). Several weeks has passed and CSCU has not sent court order to my employer! Support still being sent to CSCU by my employer and CSCU has not reimburse me . Checks aren't going to ex-wife of course but CSCU are holding my money for what ever reasons. I've called CSCU and have been given lip service. Can I obtain court order some how and give order to my employer?

Re: emancipation court order

If your son is 21, then the deductions should stop. A possible explanation is that there is a back debt on the support and the new deductions are merely catching up.

If this is not the case, send a copy of your son's birth certificate to CSCU to show that he is 21 and payments should stop. If that does not work, contact the court directly. Take off the day and go to the courthouse yourself.
