Good evening, i was legally seperated back in june of 04. Do I have to have his consent to go through withe the divorce?

Assuming you signed and filed a Separation Agreement with the County Clerk, you would have to file and serve papers for the divorce. Essentially, you would have his consent - unless he argues that the signature on the Separation Agreement is not his.
