Legal Question in Family Law in New York

Grandparent's rights

My mother is seeking visitation of my 7 year son. She attempted suicide this year and is medicated. This attempt is a final straw for me. She has seen my son every couple months the previous year. She has a habit of cancelling on him at the last minute. When he is there she sends him alone upstairs to watch TV so that she can watch her shows. (She told me that when I called.) I have tried to limit MY relationship with her. She is destructive and mean at times. Now since the attempt she has asked to see him once. (he had hockey practice) Her phone calls to me have been fighting words does not ask his concern. I don't feel that he is safe with her mentally or physically? What do you think my chances are in court?

Thank you.

Re: Grandparent's rights

You have raised serious issues concerning your son's welfare [and also your mother's].

Suggest you continue to resist visitation. If your mother ever files a GP visitation petition, please feel free to call me.

In the meantime, suggest you get together with other family members and try to get your mother some help.
