Legal Question in Family Law in New York

My husband has been paying child support. We had learned that the child has not attended school all if not most of the year 2008/9 and is working, live with the mother off and on.

Can we take the mother back to court to stop the child support and also recover for the year that she has not been attending scool

Q. Can we take the mother back to court to stop the child support and also recover for the year that she has not been attending scool.

A. You may file a petition to declare the child emancipated. Of course, you may ask for back support, however, it is my experience that the Court will not grant such a request.
