Legal Question in Family Law in New York

Inheritance/Divorce

My wife of 34 years has just received an inheritance of approximately 750,000 dollars. I have 225,000 dollars in an IRA and a pension of 2000 dollars a month. Would she still get half of what I have, on top of her 750,000 dollar inheritance if we Divorced? I fully understand I am not entitled to her inheritance, but it should be taken into consideration when determining a settlement aggreement

Re: Inheritance/Divorce

Yes, it can be taken into consideration, and a lawyer would have to fight very hard to lower the amount of the IRA and a distributive award of the pension.
