Legal Question in Family Law in New York

Interstate visitation

I am the father currently living in California. My children now live in New York with their mother. I wish to move closer to establish visitation. Is it easiest to establish visitation if I move to the same state (NY) or is it just as easy to get visitation if I move to eastern Pennsylavnia which is a more affordable place to live?

With children, the court looks at their best interest (not yours). So you have to look at the issue in the child's point of view.

If you lived in the same neighborhood as the children, visitation would be easy. Maybe the children would be able to walk to your house. Compare this to a 30 minute drive, or an 1 1/2 drive.

Therefore, to answer your question, it is easiest to establish visitation if you move to NY since it would be easiest for the children to see you.
