Legal Question in Family Law in New York

I was married to an Irish citizen and we have a son, born in the US. He lives with his mother in Ireland, but our divorce and custody issues were dealt with in NY State. There is clause in the signed agreement that she has 'surrendered herself, including custody issues to the jurisdiction of NY State. I am planning on pursuing custody of my son when he is here next summer. Does the hague convention come into play with this whereas it 'cancels out' NY State's jurisdiction?
