Legal Question in Family Law in New York

medical support

MY ex-husband had braces put on my daughter during one of her summer visitations more than 3 years ago. At that time I lived in CA and he in OR. He made arrangements to pay the orthodontistin Oregon. Soon after I moved with my daughters to NY and found a new orthdontist to take over. My ex made arrangements to pay them but I was the one signing all the forms. As of today my daughter is still in braces and can not go back until payments have been made .I can not afford to pay them since I do not even receive child support. Can I sue him for payment of this bill,or am I going to have to foot another of his bills?

There is no reason why you are not receiving child support or paying all of the medical expenses. I suggest you speak with an attorney regarding enforcement and collection issues.

I am curious as to why you are not receiving child support. What were the terms of your divorce decree? Assuming that the father is liable for at least part of his daughter's medical expenses, the key issue is obviously enforcement. Yes, you may sue him for the money. but you may also have your attorney go back to the original court that settles the child custody, etc issues and request an order to have him pay.
