obtaining custody of 14 year old daughter

My husband wants to get full custody of his 14 year old daughter even thought he pays child surport and his daughter has been living with the mom from birth.his daughter is now here visting for the summer from arizona, which they just moved too. My husband lives here in N.Y. Now my step daughter dose not want to go back to arizona and wants to live with her dad . there is no legal custody order in effect. only child surrport.Given that there is no custody order can he legally keep her here and fight fot full custody.and how will that effect the mom in arizona.Will the courts listen to what his daughter has to say. Can this be fought in N.Y.

The question is where has your husband's daughter been living over the past year. There are interstate custody laws that govern what state can decide custody. If she has not been in Arizona for 6 months and if she lived in NY before she moved, NY can handle this case. It would be a good idea to discuss the strategy of how to handle this matter. More info needed to say if case can be brought here. If it is possible NY courts will listen to a 14 year old to an extent.
