Legal Question in Family Law in New York

what is an order of seizure?

My husband and I are seperated. He is in NY state and I am in Michigan. I was awarded one of his cars. Now I need to write up an order for the police to go with me to seize the car. Help, please!

Sorry, but this is not a site for free legal services. Attorneys charge for their work product. We do not work for free as I am sure you do not. You would probably not go to work and tell your boss to forget the paycheck, it's on you. If you need an order, you will need to seek the help of an attorney who will be fair and reasonable with his or her fees.

Re: what is an order of seizure?

There are form orders to seize property. Go to

www.courts.michigan.gov/scao/courtforms/generalcivil/gcindex.htm and click on MC 19.pdf and this will get you the form. Fill it out, have it signed by the judge. Now, for the hard part......assuming the car is in New York, you will then have to go to New York and start a new suit, serve your ex-husband and request that the court enter a New York order to seize, based on the Michigan order. Once the New York court grants the motion and signs the order, then deliver the order to the local New York sheriff, civil division and have them get the car. William S. Stern
