You need to file a petition for modification of child support in the family court immediately. Otherwise your arrears will accrue and one day in the future your ex can go to court and demand the full amount for both children. The longer you wait to file the petition the more that your arrears will accrue. The court cannot waive child support arrears so you will be stuck paying the full amount. If you need legal assistance please feel free to call me or email me.
