Does a pre-nup agreement have to be drawn up by an attorney in New York State? Does it have to be filed anywhere? Can a pre-written form be used off of the internet?

A. No, it does not have to be drafted by an attorney. However, an attorney generally understands the law and is qualified to draft a pre-marital agreement.

Q. Does it have to be filed anywhere?

A. No. A pre-marital agreement is not filed.

Q. Can a pre-written form be used off of the internet?

A. Generally, yes, but I would not recommend it.
