Legal Question in Family Law in New York

prenuptial filings

Hi. I'm a new attorney who has done several matrimonials. I have a Nassau County client who needs a prenuptial agreement. Should this document be filed at the Nassau County Clerk's office in NYS?

Re: prenuptial filings

Welcome to the profession.

There is no need to file a prenuptial agreement with the County Clerk. However, in order to protect yourself as well as your client, you should make sure that the document is not just notarized but also witnessed by individuals other than the notary.

Additionally, each page should be initialed by the parties.
