Mother, ex-wife of 5 kids no Will has a brother who has the first rights to her property?

I am not sure if I understand your question.
If your question is whether decedent's brother or children receive money from an individual that died intenstate, then the answer is the children would equally receive under the estate. The uncle would receive nothing.
