Separation Questions

How long does a person be separated before they can be considered legally separted? Does paperwork have to be filed for a seperation.

Yes, a separation agreement must be both properly signed and filed for it to be effective. The waiting period in New York before such an agreement can be converted to a divorce is one year.

You are not legally separated, no matter how long you live apart, unless you have a signed/notarized separation agreement filed with the court AND you substantialy abide by it.
