Legal Question in Family Law in New York

Seperated Sick Spouse

I have been seperated from my spouse for 16 years and we have a family court order of custody dated many years ago. He (spouse) is now ill and will be going on medicaid. My home was purchased after we had been apart 4 years and his name has never been on the deed. We live in NY. Will Medicaid try to take my house

Re: Seperated Sick Spouse

No. He has no marital or other interest in the property. It is not a marital asset.

It would be better if you had a separation agreement establishing the above.
