Legal Question in Family Law in New York

Suing for home ownership

My wufe has left the country 3 and a half years ago, her name is still on the deed to the house. We have not gone to court for legal seperation or divorce. Can I sue to get her name off of the deed, and win? She also has taken the children, and I cannot get them back. We never had any incidents of abuse.

YOu should divorce her on grounds of abandonment. If she fails to respond and defend, you should be able to get the house in default. Further you may have waived your rights to fight for the kids in NY but you will have to see a lawyer about this.
