Legal Question in Family Law in New York

Visitations

I am presently separated from my husband for almost 4 years due to a domestic violence situation to the extent that he had tried to suffocate me several times and supposedly in the state of anger that he was each time he had no self-control at all and still states that I am lying, crazy and he did no such things. About a lil over a year ago he got visitation privileges with my 2 children despite my concern for his drug problem, not really being an adequate caretaker or disciplinarian of children. They allowed the visits despite the fact that my older son is only his stepson and despite the fact that he has allowed family members in that household to threaten and abuse him in the past. Particularly my 14 year old son which is only the stepson had become for me an extreme discipline problem. He barely goes to school, had become violent in the household and goes in and out of the house as he pleases. I have caught him and the stepfather having discussions about how terrible I am. My son says that I am the cause of the family being separated. What kind of mother am I. The words of his stepfather when he gets a chance to speak to me on the phone. The original court visit file has that my husband signed my stepson as his so

Re: Visitations

It is not clear what you want. Do you want to terminate/restrict his visitation rights? You can apply to the court to terminate his visitation rights to your eldest son if he is his stepson or restrict his visitation rights to supervised visits.

You can call me on 718-715-0514 to discuss this matter further or any other legal issues.
