Legal Question in Family Law in New York

New York State Family Law

My son James will turn 18 on 01-01-08 and will also graduate H.S. early in Jan. He will not be in school. Does support stop at 18 or 21 yo and if continue to 21 yo does he have to be in school ? Thank you for your time.

In NY support continue until 21 and maybe beyond depending on whether kid is in school, trade etc. If kid is working gainfully there may be no obligation to support him. If kid is in college and parent can afford it then support continues until graduation. In NY support does not automatically cut off . One must go to court to request termination of support.
