New York State, Onondaga County

I have a 19 year old son and his mother has full custody. Three months ago the child obtained two part-time jobs, dropped out of college and moved into an apartment with a friend outside his mothers control. I petitioned the court and asked that the child support to the mother be stopped. The judge ordered the child support to stop and the mother did not object.

Three months later, the child is still living on his own, but has recently enrolled in a full-time college. The original divorce decree does not require me to pay for the child�s education or college aid .

I understand that my son can petition the court for child support but does the mother share some financial responsibility?

Any in sight would be greatly appreciated

Both parents must provide financial support to their children. So yes, she bears some financial responsibility. The issue is whether you are gonna be on the hook for his education since you did not have an agreement in place during the divorce. Generally, the answer is no.
