Legal Question in Medical Leave in New York

I have a questoin.. I am seperated from my husband ( not legally but he has benn out of the house since dec 08) We are in a custody battle for the kids.. at this time he has temp custody. He came to my house last night at 11:30 pm and was snapping pictures outside my windows of the inside of the house.. I called my laywer and he hung up on me .. i need to know if this is legal or not and if not what can I do about it. TY and have a great day.

Assuming his name is not on the deed or lease, it is illegal to trespass on your property. You can make a criminal complaint.
