Legal Question in Medical Leave in New York

Working on FLMA

I've taken FLMA due to birth of new child. my employer alows up 4yrs on FLMA. I've taken 18 mths. I am unable to return to the 9-5 work schedule, can i seek part-time employment else were under the FLMA act. Or must I resign from my current employer, before saeeking new employment of any sort.

There is no statutory right to seek part-time employment under the FMLA, which only provides job protection for 12 weeks. If your employer permits 4 years(?) of FMLA leave and you've only taken 18 months, you should formally propose a part-time or consulting arrangement with them. With that type of generous FMLA leave policy, they would probably consider alternative arrangements.
