Legal Question in Civil Litigation in New York

120 ft Retaining Wall/ Neihbors

There is a wall between ours and the neighbors property.THe back portion had fallen before either owned the properties. When the neighbors moved in they said they had a survey and it was ours. They said put in a planter box over it and it will never be a problem so we took them at their word and did so.This has been going on for 11 yrs since they moved in.They want the wall done we had contractors here. They say that it is the neighbors wall because of the driveway they have.It not in our deed or our survey. They've called the city on us and the guy told her it is not a danger because cracks that are in the wall that is still standing are old. They had an attorney write a letter saying that my father built the wall and to rectify it.Needless to say it was full of lies, and we called the attorney and told him. We haven't heard anything since. Now the neighbors are tearing out the planter box in the back of the prop.To in their words expose it.It now looks how it did when they bought their prop.1/3 of a wall laying in the back of the drivway. They are commenting that it is great look at all the damage. What can be done. This is non stop with these people.Shouldn't they have to prove who's property it belongs to before threatening us?

Have your own survey done and find out whose property the wall is on. If necessary, you can bring a court proceeding.
