Legal Question in Civil Litigation in New York

Auto Accident Damages

I was broadsided by a government entity. My vehicle is a 1984 GMC and sustained $2300.00 in repairs, $375.00 in environmental clean-up cost (gas tank ruture) and two days rental car fees while my truck is repaired.

Kelly Blue Book and NAPA estimate the value of the truck as equipped at between $2500.00- $4,000.00.

My questions are as follows:

What goverment agency over sees government self insured issues?

Can the government ''total'' my vehicle and pay me some ridiculous $500.00 fee or something?

If I am not satisfied with the governments offers can I take the driver to small claims court to recover my total losses?

Re: Auto Accident Damages

It depends on which government, Federal, New York State or local government. Assuming NY State, you should immediately file a Notice of Claim before commencing a small claims action.
