Legal Question in Civil Litigation in New York

Bro & Sis residential co-ownership issues... buy-out

My sister & myself co-own a residence in New York. I live in the home and my sister lives in Maryland. When we inherited the home, it was in deplorable condition. For the last 10 years, I've put approx $150,000 into the home. My wife & I have put hundreds of thousands of hours of labor in home improvement. We've paid all property taxes. We offered my sister a more than fair offer for her remaining equity. (She has received two $20,000 payments from us towards a buy-out) She won't sell and won't pay back $ we gave her. We are between a rock & a hard place. We can't do anything without her consent.

An action for partition should be brought in NY.

The court should order the sale to you.

You should retain an attorney to commence a partiction action. This is a request that a Judge force a sale of the property. You can also address the money you gave your sister as part of the action. My office can handle this matter if you would like to call us at 212-622-7180.

You can start an action requiring your sister to contribute to the upkeep and taxes of the home. If she has not paid anything she has been receiving afree ride. Why would she want to stop it?
