Legal Question in Civil Litigation in New York

''He says I damaged his vehicle''- next Jenny Jones

I parked in a hotel parking lot on a Friday afternoon. I recall the parking space was a tough one to get into, but nothing terrible. When I pulled out of the lot Saturday night I noticed a note on my windshield. It read, '' To the owner of this vehicle- your car scraped mine. (Look at the parking line- you're over it.)An employee of the hotel has witnessed the overhang of your car and I have taken a picture of your car and license to avoid an insurance claim. Please contact me Mr.----- at room ---of the ----- Hotel to discuss the repair of my bumper and rear.'' I promptly turned around and went back to the hotel and called him in his room. I asked him which car in the lot was his- I wanted to see my supposed handiwork. He refused to allow me to see his car and told me that he had since moved it. (He also said that he noticed the damage when he was backing out and felt contact between the two cars, soit must have been my fault for parking so close (?!)He has no witness to my doing the damage, and I have no recollection of making any contact with his car. Id like to be honest about this, but this fellow isn't very accomodating. What should I do?

I don't beleive this rises to the level of extortion (no demand sought -- no punishment for failure to comply inferred) andI don't think most District Attorney's would label this a high on their invstigatory to do lists.

That being said, you should notify your insurance company about the note and your version of events. I would not be surprised if that's the last you have to deal with it.

Should you like to discuss this or any other legal matter, you can call my office to schedule an appointment for a consultation or in the alternative, I can be reached for on-phone low-cost legal consultation at 1-800-275-5336 x0233699.

This cannot be easy for you. If you have his address I would recommend a strong letter from your attorney. If you have other information, write a letter to the district attorney of the city where the hotel is located. (the crime is 'extortion', and this is a classic example).

Being pro-active can be helpful.

I would be happy to assist you by writing the letters for no fee.

You are welcome to a consultation at my offices at 42 West 44th Street. Please call for an appointment first; (646) 591-5786.
