Legal Question in Civil Litigation in New York

Dog attack on my property

My next door neghbors have a female Pit Bull. I have two dogs , a male and a female. My yard is fenced in, theirs is not. They let the dog out without a leash. It comes accross my property and attacks my dog all the time. Thia morning at 6 AM their dog went behind my garage and knocked down my fence. It came into my yard an attacked my dog. She tried to get to my dogs neck, but thank God she wasnn't hurt. I called the police, but they said iit is a civil matter, and they couldn't do anything. Of course there were not any witnesses outt that early, that I know of.

I reported it to the town once before by letter which the lost of course. Now i will probably have to try another one. Do I have any legal grounds here.

As your fence in disrepair? How did a dog knock down your fence? If you bring a civil trial these may be issues relating to the damage to your property. In any case, you should speak to your neighbor about the situation.

If they prove impossible to talk to, and assuming there are leash laws in your area you can call the local county or municipality agency that deals with animal control.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.

Respectfully, how about building a stronger fence?
