Judgement Against a Client

I am helping a Chinese couple buy a home and the mortgage company has informed us that the lady has a judgement against her in New York City. She was an 18 year old in China when the judgement was filed. The collection company will not coorporate with information and we would like to know who we should contact in the city or state government to help. The attorney's office in ny will not answer calls or faxes to our attorney here in del. Any help would be very much appreciated. Thank you

I do not believe that any governmental agency will help. You need to have someone look at the alleged debt and court filings supporting the judgment, and then challenge the judgement in court. It has also been my experience that having a new person talk to the collection agency is sometimes helpful. Please let me know if you need anything further.

This is a far more common problem than you may realize.

The simplest action is to make a motion to set aside the judgment on the basis of lack of service.

Documentation of your client's residence at the time the action was filed is needed.
