Legal Question in Civil Litigation in New York

Neighbor dispute over trees

I have a neighbor that has sent a letter to me saying his homeowners insurance company told him to send a letter placing us on notice in case of any future damage/injuries to anyone or property due to trees.

1. Can their homeowners insurance advise them to do this?

2. Is this legal?

3. Do we have to comply?

What should we do?

Q 1. Can their homeowners insurance advise them to do this?

A. Yes.

Q 2. Is this legal?

A. Yes.

3. Do we have to comply? What should we do?

A. No, you do not have to comply. However, if your trees are rotting or may possibly damage your neigbor's house, car or property, I would take the necessary steps to reduce the risk.

Mike.
