Legal Question in Civil Litigation in New York

Do I have to pay?

I purchased a Nikon camera thru ebay. The ads description said that it included multiple items, including a lens and a battery- which weren't with the item. I tried to resolve the issue amicably, but to no avail. I got one sarcastic response from the seller and he wouldn't even uphold the return policy. So I contacted my credit card company who ultimately sided with me after their own investigation. Now, months after the transaction, the seller contacted me by email and said that if they don't recieve the camera in mint condition then they are going to file a police report. Should I be worried? I don't think they deserve anything, especially after not honoring their own return policy, which I tried amicably to use multiple times. Mind you, I have all of the emails and correspondence with the seller still at my disposal which will prove my argument, and the seller is from New York and I live in Philadelphia. Should I be worried?

Re: Do I have to pay?

I can't imagine the police will be too interested. This is a civil dispute and it sounds like you have defenses. If you have paid no money towards the camera, after succesfully challenging, send it back to the seller, then there should be no issue.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
