Legal Question in Civil Litigation in New York

I was scammed!

I was scammed online. The guy gave me a fake cashier's check.I didn't know so I brought it to my bank. I waited until they cleared it and then I wired the money to this guy not knowing that it was fake. The next day my bank called and said it was fake! Now they want me to repay and I can't afford it. Shouldn't they be responsible because they told me it was clear and after I wired it then they called? Should I sue my bank? jackie

Re: I was scammed!

Most likely, you'll have to pay the money back. I'd need to know a little more about what the bank told you concerning whether or not the cashiers check cleared, but the depositor is generally responsible for instruments that are dishonored by the "drawing" institution. I would recommend examining your account agreement before doing anything else.
