Legal Question in Civil Litigation in New York

Small Claims Court - Engagement Ring

Hi

I am a defendant to appear in New York State, Town Small Claims Court. The person who brought me to court is sueing for money that he paid for an engagement ring that he gave me. 5 days prior to the Wedding, he canceled the marriage and left me. That was almost a year ago. He never asked for the engagement ring back. Now, almost a year later, I get a notice to appear in small claims court for the cost of the engagement ring. My questions is: 1. Isn't an engagement ring a gift? 2. Am I responsible to return it when he broke off the marriage?

Thanks.

You are correct. Bring a witness with you who can verify your version of what happened. Good luck.
