Legal Question in Civil Litigation in New York

My son was charged for a theft he did not commit in Florida but lives in New York. To end the case, he plead No Contest and I paid the restitution on his behalf. The bank where he was employed in Florida has confirmed after-the-fact that the money was not taken. My question is, can the restitution paid to the bank to end the case be recovered with a law suit in New York since that is where the money came from or am I "barking up the wrong tree"? The bank suffered no loss or damages.

No. Any lawsuit would be venued in Florida. Perhaps a letter to the bank will suffice. Your son needs this matter removed from his record. Good luck.
