Legal Question in Civil Litigation in New York

Stole My Tax Return

Stolen Tax Return

I got my taxes done at professional agency, received my

refund already, etc.. Just kicked an ex-boyfriend out of

my home and have now discovered that he stole my tax

return paperwork because its gone from the private

place I tucked it away way up in my closet and no other

adults have access to my apartment and my young son

couldnt even reach up where Id hidden it and I KNOW I

didnt inadvertently move it myself.

It included all the printed stuff in an envelope (the W2,

their printed paperwork of my tax return, the amount of

my refund, and also this paperwork included mine and

my son's SS#'s on it).

A) Should I be in a state of panic at identity theft or any

other illegal possibilities as a result of him stealing it. If

I'm filing, then he call attention to himself by adding

mine or my son's SS# on his return wont he? Then

HE'd be the one audited right?

B) What precautions can I take to prevent anything

bogus or illegal done with knowing hes got my tax

return.

Re: Stole My Tax Return

You are in the wrong catergory but I'll give it a shot.

A. If you are sure its not misplaced, then the question is, does he have the ability or character to be able to dco something with the info. Is he a hacker, or does he know any people capable of messing around in databases?

If so, yes, you should immediately notify all financial instituions you use that there has been an identity theft incident; they will either tell you to change account numbers, or use other precautions depending on the nature of the accounts ionvolved.

I have been involved in situations where people in personnel departments were stealing ID info, and applying for car loans, etc.

You said that the following is missing:

(the W2, their printed paperwork of my tax return, the amount of my refund, and also this paperwork included mine and my son's SS#'s on it).

Only the social security # are private and there is not much that some one else can do with only that alone. The company that did the return should be able to provide another copy. Look and see just what is there to be concerned about.

Besides telling your bank and credit cards, if he got that info, tell the police. Make a report.

Re: Stole My Tax Return

My colleague gave a solid answer. i onlyn want to add that you may apply for a new social security number in a situation like this. You must apply directly to social security.

An ounce of prevention is worth quite a lot. So please take my colleagues advice on the credit cards and other financial institutions.

Good luck.
