Legal Question in Civil Litigation in New York

Utility pole placement

I have a utility pole placed by my electric co. which is blocking access to my driveway. If the pole were moved approx 3ft to the adjourning property line it would solve the problem. What legal avenues do I have? The pole has been since I purchased the property in 1990.

Re: Utility pole placement

The electric company probably has an easement on your property. An easement means "right of use." Therefore, the electric company probably does not have to move the pole.

However, if you offer to pay for moving the pole the electric company may consent to your request.
