Legal Question in Immigration Law in New York

I want to be deported. But not without my daughter
I want to be deported( really). But not without my daughter. She is being refused her right to identity. The question is what's the worst that could happen in a court (filling for my child's birth certificate), if I show up without any status ?
( The thing is this lawyer wants me to reapply. And I really don't care for it. So I am looking for possible causes. Why is she so nervous?)

We would need more information regarding your situation, such as, how old is your child and was the child born here in the US.
