Legal Question in Immigration Law in New York

I want to be deported. But not without my daughter

I want to be deported( really). But not without my daughter. She is being refused her right to identity. The question is what's the worst that could happen in a court (filling for my child's birth certificate), if I show up without any status ?

( The thing is this lawyer wants me to reapply. And I really don't care for it. So I am looking for possible causes. Why is she so nervous?)
