Legal Question in Immigration Law in New York

my boyfriends father, is in progress of getting deported. my boyfriend is also illegal in the us. i dont want him to get deported and i know him and his mom is next. he is only 18, im willing to marry him, but at the last resort. is there anything he can do? if i do marry him, since im so young and in college are they going to see if we live together and everything?

If your boyfriend arrived in the US illegally (without inspection), then marrying him will not save him. On the other hand, if he originally arrived in the US legally, but simply let his visa expire, then you should marry him quickly and apply for his green card... this would save him from deportation.

A lot depends on whether your fiance entered the country with or without inspection. If he did enter without inspection, he may still be eligible to adjust if he qualifies for 245(i), which would require a petition or Labor Certification to be filed on his behalf prior to 4/30/2001.
