Legal Question in Immigration Law in New York

Visitors Visa Renewal

Hi, I'm here on a visitor's visa and would like to stay longer. They gave me 6 months. What is an acceptable reason for filing for an extension? Or must I travel outside the US and return in order to get another 6 months? If I have to trave outside the US, do I need to return to my home country or can it be any non-US country? I have a ten year visitors visa.

Re: Visitors Visa Renewal

You may be eligible to apply for an extension of your visitor's visa while in the US. These applications are taking about 4-5 months to process, and you will be permitted to remain in the US while the applicaiton is pending. Generally, you can request an extension for 6 months.

With regards to travelling outside of the US, and then re-entering with your current B-2 visa, there are certain risks to consider, including how long you stay outside of the US prior to re-entering that you should consider.

To discuss all of your options in detail, I recommend that you seek the advise of an attorney.
